Inventorying Employment Restrictions Act

The Task Force on Inventorying Employment Restrictions Act [20 ILCS 5000] was created to review the statutes, administrative rules, policies, and practices that restrict employment of individuals with a criminal history, and to report to the Governor and the General Assembly those employment restrictions and their impact on employment opportunities by July 1, 2013. By statute all state agencies must submit a report that describes restrictions for employment within the agency, in facilities licensed, regulated, supervised, or funded by the agency, and in occupations that the agency licenses or provides certifications to practice.

Summary of Employment Restrictions for State Hiring and Occupational Licensing

In accordance with the Task Force on Inventorying Employment Restrictions Act, a summary of criminal history-based restrictions on state employment and occupational licensing has been compiled for all state agencies included in the Act. The information is based on agency reports submitted to the Task Force and supplemental research of Illinois statutes and administrative codes.

The summary is organized by six functional categories of agencies:

  • Economic Development and Infrastructure Agencies (13 agencies, boards and commissions)
  • Education Agencies (7 agencies, boards and commissions)
  • Environment and Business Regulations Agencies (11 agencies, boards and commissions)
  • Government Services Agencies (19 agencies, boards and commissions)
  • Human Services Agencies (10 agencies, boards and commissions)
  • Public Safety Agencies (10 agencies, boards and commissions)

Final Report
  • The Illinois Criminal Justice Information Authority is pleased to announce publication of the Final Report of the Task Force on Inventorying Employment Restrictions. This report may be viewed and downloaded at www.icjia.org/IERTF2013/.

    Illinois Public Act 96-0593 (20 ILCS 5000) created this Task Force within the Authority, and provides that the Task Force review statutes, administrative rules, policies, and practices that restrict employment of persons with criminal history and report its findings and recommendations to the Governor and General Assembly by July 1, 2013.

    Gainful employment after release from prison is one of the critical elements necessary to achieve successful reentry, and employment has been shown to reduce recidivism. It is our expectation that the information and recommendations in this report will help empower the State's agencies, boards, and commissions to assume a leadership role in providing employment opportunities to people with criminal records while guarding against inappropriate discrimination.

Task Force members must complete mandatory training on the Open Meetings Act (5 ILCS 120/1). This one-hour training is available free of charge at the Illinois Attorney General's web site.
